Your privacy is important to ATA Recruitment Pty Ltd (ACN 153 275 551) and ATA Labour Hire Pty Ltd (ACN 153 275 711) (ATA) and we will always act in the best interest to protect your personal information and are careful about how and when your information is collected, used and disclosed.

We have a commitment to privacy in accordance with the Privacy Act 1988 (Cth) (Privacy Act). We are bound by the Privacy Act and the National Privacy Principles contained in the Privacy Act.

Your engagement of ATA to provide you with recruitment and other related services constitutes deemed acceptance of the terms of this Privacy & Collection Statement. Should you not agree with the terms set out in this Privacy & Collection Statement, please notify ATA in writing as soon as possible. A copy of this Privacy & Collection Statement is available on the ATA website. This Privacy & Collection Statement may change from time to time, so please refer to it regularly.

Any information collected after an amended Privacy & Collection Statement has been posted on ATA's website will be subject to that amended Privacy & Collection Statement.

What your Personal Information is

"Personal Information" is any information or an opinion (whether true or not) about you, from which your identity is apparent or can reasonably be ascertained. It may include the opinions of others about your work performance, (whether true or not), your work experience and qualifications, aptitude test results and other information obtained by us in connection with your possible work placements.

Personal Information includes sensitive information as defined in the Privacy Act. It could include, for example, relevant information about your health and information obtained lawfully via a criminal history check.

We will only collect, maintain and use Personal Information about you if it is necessary for us to adequately provide the services for which we have been engaged and, subject to any exceptions at law, we will not collect sensitive information without your consent.

For the purposes of this Privacy & Collection Statement, all references to Personal Information include references to sensitive information.

Who will be collecting your personal and sensitive information

Your Personal Information will be collected by ATA.

How your information will be collected

Generally, Personal Information will be collected from you directly when you fill out and submit one of our registration forms or provide us with any other information in connection with your registration with ATA.

Personal Information may also be collected from other persons when:

  • we receive any reference about you;
  • we receive results of inquiries that we make of your former employers, work colleagues, professional associations or registration body;
  • we receive the results of any competency or medical test;
  • we receive performance feedback (whether positive or negative);
  • we receive any complaint about you in the workplace;
  • we receive any information about a workplace accident in which you are involved;
  • we receive any information about any insurance investigation, litigation, registration or professional disciplinary matter, criminal matter, inquest or inquiry in which you are involved.

How your information may be used

Your Personal Information may be used to enable us to adequately perform the services for which we have been engaged, such use may include but will not be limited to use in connection with:

  • the provision of recruitment services by ATA, including without limitation to identify potential new employment opportunities available to you and to notify you of these from time to time;
  • your actual or possible work placement;
  • your performance appraisals;
  • our assessment of your ongoing performance and prospects;
  • any test or assessment (including medical tests and assessments) that you might be required to undergo;
  • our identification of your training needs;
  • any workplace rehabilitation;
  • our management of any complaint, investigation or inquiry in which you are involved;
  • an insurance claim or proposal that requires disclosure of your Personal Information.

Disclosure of your Personal Information

Your Personal Information may be disclosed to:

  • potential and actual employers and clients of ATA;
  • referees;
  • associated entities of ATA or entities carrying out functions on behalf of ATA;
  • our insurers;
  • a professional association or registration body with a proper interest in the disclosure;
  • a Workers Compensation body;
  • our contractors and suppliers – e.g. our I.T. contractors and database designers;
  • any person with a lawful entitlement to obtain the information.

Accuracy and completeness

While ATA endeavours to ensure that the Personal Information collected from you is up to date and complete, we may assume that any Personal Information provided by you or other persons is free from errors and omissions, is not misleading or deceptive and complies with all relevant laws.

You should provide us with details of any changes to your Personal Information as soon as reasonably practicable following such change.

If you do not give us the information we seek

If you do not give us the information we seek:

  • we may be limited in our ability to locate suitable work for you;
  • we may be limited in our ability to place you in work.

Security of Personal Information

ATA takes all reasonable steps to protect your Personal Information collected and held by us, from misuse, loss, unauthorised access, modification or disclosure.

ATA's security measures include:

  • securing all files containing Personal Information in locked cabinets;
  • only providing staff, who are subject to confidentiality obligations, with access to Personal Information;
  • securely destroying Personal Information after any applicable legislative or professional retention period;
  • ensuring computer security through the use of firewalls and up to date virus software;
  • password access to computer systems;
  • audits of the computer systems.

You can gain access to your Personal Information to correct it if it is wrong Subject to the exceptions which are set out in the National Privacy Principles (Principle 6 – Access and Correction), you have a right to see and have a copy of your Personal Information that we hold. If you are able to establish that Personal Information that we hold about you is not accurate, complete and up-to-date, please inform us. We will take reasonable steps to update the information if we agree that it requires correction. You may be required to provide evidence of the proposed corrections. If we are unable to agree that Personal Information that we hold about you is not accurate, complete and up-to-date, you may ask us to place with the information a statement by you that claims that particular information is not accurate, complete and up-to-date. If you wish to exercise your rights of access and correction you should contact our Director whose details are shown below. You will be required to complete a request for access form and verify your identity to the satisfaction of ATA. We will endeavour to fulfil to any request for access within 14-30 days depending on the complexity of the information and/or the request. In some cases we may impose a moderate charge for providing access to personal or sensitive information. You will never be charged a fee for lodging a request for access.
